My office has received many emails and calls regarding this proposed development. As a Councillor I am at arm’s length from the Committee of Adjustment, but residents can submit their comments or request to speak at the hearing.

If the application is granted, then the proposal for 10 units PER LOT would be considered zoning compliant, they can proceed directly to building permit and no notification to the community is required. The subject property is zoned (Local Commercial Zone, LC) which permits low rise apartment dwellings and stacked dwellings.

City staff will provide comment on the application to the Committee of Adjustment, their comments will include examining the request to reduce parking minimums.

It should also be noted that the current Zoning By-law Flood Plain Overlay would be used in the review of the application for 243 Bradford Street. The most current flood plain mapping is now georeferenced, which ensures accuracy. Previously mapping would have been hand drawn.

There are no provisions for the Committee of Adjustment or the Ontario Land Tribunal to extend the statutory deadline to file an appeal. If the deadline is not met, the OLT does not have the authority to hold a hearing to consider your appeal.

APPLICANT’S PROPOSAL AND PURPOSE OF THE APPLICATION:

[1] The Owner wants to construct a four-storey, low-rise apartment building, as shown on the plans filed with the Committee. The existing dwelling and shed will be demolished. REQUESTED VARIANCE

[2] The Owner requires the Committee’s authorization for a minor variance from the Zoning By-law as follows to permit 13 parking spaces (for residents), whereas the By-law requires a minimum of 14 parking spaces.

Evidence considered by the Committee included any oral submissions made at the hearing, and the following written submissions held on file with the Secretary-Treasurer and available from the Committee Coordinator upon request:

The Committee considered all written and oral submissions relating to the application in making its decision and granted the application.

Based on the evidence, the Committee is satisfied that the requested variance meets all four requirements under subsection 45(1) of the Planning Act.

The Committee notes that the City’s Planning Report raises “no concerns” regarding the application, highlighting that “the reduction of one parking space will not have an undue adverse impact on the overall enjoyment of the property given that the site is located within walking distance of amenities and is located near frequent and local transit routes.”

The Committee also notes that no evidence was presented that the variance would result in any unacceptable adverse impact on neighbouring properties.

Considering the circumstances, the Committee finds that, because the proposal fits well in the area, the requested variance is, from a planning and public interest point of view, desirable for the appropriate development or use of the land, building or structure on the property, and relative to the neighbouring lands.

The Committee also finds that the requested variance maintains the general intent and purpose of the Official Plan because the proposal respects the character of the area.

In addition, the Committee finds that the requested variance maintains the general intent and purpose of the Zoning By-law because the proposal represents orderly development on the property that is compatible with the surrounding area.

Moreover, the Committee finds that the requested variance is minor because it will not create any unacceptable adverse impact on abutting properties or the neighbourhood in general.

THE COMMITTEE OF ADJUSTMENT therefore authorizes the requested variance, subject to the location and size of the proposed parking being in accordance with the site plan filed, Committee of Adjustment date stamped June 27, 2023, as it relates to the requested variance.

Tree Report:

No development has been proposed for this site at this time. When development is proposed, grading may make tree retention difficult.

Due to its size and relative uniqueness, Tree 5 in the report (Ginko) is of high value for retention, and, if possible, future development should limit grade changes within its Critical Root Zone. Tree 5 is also close to the zoned building envelope and in order to protect this tree successfully, excavation for the new home should be at least 3 m from the edge of the trunk.

All other trees on this site do not require any action as there is no proposed development on the part of the property with an existing structure. When development on that part is proposed, tree protection should be assessed based on the plans submitted.

The Committee of Adjustment does not condone the practice of building first and asking for permission later. An owner who does so runs the risk, like any other applicant, of having their application denied. The additional risk if the Committee refuses to authorize a minor variance for an already-built, non-compliant structure could be the requirement to either bring it into compliance or remove it, regardless of any cost or hardship to the owner.

Whether the proposal has already been built does not factor into the Committee of Adjustment’s decision, either negatively or favourably. It is the same approach the Ontario Land Tribunal (formerly the Local Planning Appeal Tribunal and previously the Ontario Municipal Board) takes when considering cases where minor variances are requested to legalize, after the fact, an already-built structure that does not comply with zoning regulations.

The law requires the Committee of Adjustment to hear every applicant and everyone who wants to be heard in favour of or against the application. The Committee must consider each application on its merits, based on the evidence and according to the statutory test. The Committee may authorize a minor variance if it is satisfied that all four requirements set out in subsection 45(1) of the Planning Act are met. It requires consideration of whether: the variance is minor, is desirable for the appropriate development or use of the land, building or structure, and whether the general intent and purpose of the official plan and the by-law are maintained.

For a minor variance application, the Planning Act does not set out a fifth test as to whether an owner has contravened municipal regulations relating to construction. The Planning Act also does not allow the Committee of Adjustment to impose penalties on an applicant for hearing their application, for whatever reason. Instead, it is the City’s exclusive role to address construction-related concerns and to review plans, implement any conditions of approval, issue a building permit once engineering and other issues are satisfied, inspect building sites, enforce its own by-laws, and impose any appropriate penalties. As an independent tribunal, the Committee of Adjustment has no jurisdiction over such matters.

Remote Participation – Committee Members, Staff and General Public

City facilities are temporarily closed to help stop the spread of COVID-19. Although in-person Committee of Adjustment hearings have been postponed until further notice, there are several ways in which the general public can participate in this electronic hearing.

The chosen technology for this hearing is Zoom (https://zoom.us/) which allows for participation by computers and mobile devices. To reduce the number of participants in the electronic hearing and to allow for a more efficient process, the general public will be asked to participate by viewing the webcast via the Committee of Adjustment YouTube channel at https://www.youtube.com/channel/UCZ9Z3-VJcSMSqrWRORMlRjQ. You can also contact cofa@ottawa.cato obtain the link.

Submit comments in writing: submit comments in writing, by email, to cofa@ottawa.ca. Comments received by noon (12 p.m.) the Monday before the hearing will be provided to Committee Members prior to the hearing. Comments received after this time will be forwarded to Committee Members as soon as possible but may not be received by Committee Members prior to the hearing.

Submit verbal comments in advance of the hearing (Prior to noon (12 p.m.) the Monday before the hearing) you may call the Coordinator to have comments transcribed (contact details below).

• You can continue to submit your application by regular mail, along with a cheque for the applicable fee.
• You can continue to submit an appeal of a Committee of Adjustment Decision by regular mail along with the applicable fee (refer to the instructions in the Decision for details on how to proceed).  Please also email us your intent to file an appeal.
• You can continue to submit a request for a certificate by email or regular mail if conditions of approval have been cleared by the appropriate authorities.
• The Province has lifted the suspension of appeal periods during the state of emergency.  Because of this, we are required to reissue Decisions made February 19 and March 4 to reactivate the appeal period.  If a Decision is not appealed to the Local Planning Appeal Tribunal, it becomes final and binding 20 days later. 
• The Province has also decided that the period of the COVID-19 emergency shall not be included in counting the one-year time limit for fulfilling provisional consent conditions.  Accordingly, the one-year lapse period is extended during this time.

The meeting is cancelled due to Ottawa Public Health’s social distancing recommendation.
